Cookbook Create Privacy Policy

Your privacy is important to Cookbook Create, LLC (“CookbookCreate,” “we” or “us”), a Delaware limited liability company. We created this Privacy Policy (the “Privacy Policy”) to explain how we collect, use, disclose, transfer and store your information, and we hope it demonstrates our commitment to fair information practices and the protection of your privacy as you visit the website (the “Site”) and avail yourself of the services available on the Site (the “Services”). The Privacy Policy, together with our Terms of Service, which is expressly incorporated herein, governs your access and use of the Site and Services, whether as a casual visitor (“Visitor”) (which means that you’re just browsing) or registered member (“Member”) (which means that you have registered and set up an account with us). Visitors and Members are hereinafter collectively referred to as “Users” and individually, each as a “User.” Please familiarize yourself with the following terms and conditions.


  1. Our Privacy Policy, our Site and our Services.

    This Privacy Policy is only applicable to the Site and not to any other websites that you may be able to access from the Site (whether through an advertisement or content hyperlink), each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

    In order for you to access certain areas of the Site and use certain Services, we may require you to register as a Member and provide us with certain information personally identifying you, such as your first and last name, email address, telephone number, credit/debit card, shipping and billing information (collectively, “Personal Information”). You are responsible for ensuring the accuracy of all Personal Information you submit to CookbookCreate. Inaccurate information may affect the information you receive when using our Services and our ability to contact you as described in this Privacy Policy. If you access our Site without registering, the only information we collect will be non-personal information (“Non-Personal Information).

  2. Personal Information.
    1. Registration

      In order for you to access certain areas of the Site and/or use certain Services, we may require you to register as a Member of our Site. As part of the registration process, you will create a username and password. The username and password that you provide are your credentials ("Credentials") for accessing those Services that are only available to Members. You are responsible for keeping your Credentials confidential and for notifying us if they have been hacked or stolen. You may notify us by sending an email to: In order to register you will also be required to provide us with certain Personal Information, which may include your Credentials, first and last name, email address, telephone number, credit/debit card details, shipping and billing information, as applicable. We use the Personal Information that you provide to respond to your questions, provide you the specific Services you select, including to process your orders and to communicate with you about Site maintenance and updates, as appropriate. You may choose not to provide us with any Personal Information. In such case, you will not be able to access and use those Services that require your Personal Information. Subject to the Privacy Policy, if you contact CookbookCreate, we may use any of the information you submit in connection with your inquiry, or any Personal Information and Non-Personal Information we have about you when responding to your inquiries.

    2. Updating or Deleting Your Personal Information.

      If at any time you wish to update your Personal Information or if you no longer wish to be a CookbookCreate Member, simply log in to the Site and follow the applicable instructions posted under the “My Account” link. If you no longer wish to receive communications from CookbookCreate, you may opt-out of receiving them by following the instructions included in each email.     3. California Residents.

      Under California law, customers of CookbookCreate who are residents of California may request certain information about our disclosure of Personal Information to third parties for their direct marketing purposes during the prior calendar year. California residents may request such information by contacting us at the address listed at the end of this Privacy Policy.

    4. Children.

      We do not knowingly collect Personal Information from children under the age of thirteen (13).

  3. Non-Personal Information.

    Even if you do not register with CookbookCreate, we collect Non-Personal Information about your use of our Site and Services. We do not link Non-Personal Information to Personal Information.

    1. Cookies.

      We use “cookies” to recognize Users and customize User experiences on the Site. Cookies are small computer files transferred to your computer’s hard drive that contain information such as your username, User preferences, the pages you’ve visited and the activities you’ve performed while visiting the Site. We do not link the information stored in cookies to any of Personal Information you submit while on the Site. You may block or delete cookies from your hard drive; however, by disabling cookies, you may not have access to all of the Site features or Services. Some of our business partners also use cookies to provide us with anonymous data and information regarding your use of the Site. We do not have access or control over these cookies, and our Privacy Policy does not cover the use of third party cookies.

    2. Web Beacons.

      We or the third party tracking utility company with which we partner also use “web beacons” to collect anonymous information about your use of our Site and the websites of selected, partners, sponsors and advertisers, and your use certain Services Web beacons are tiny graphic image files embedded in a web page or email that provide a presence on the web page or email and send back to its home server information from the User’s browser. The information collected by web beacons allows us to statistically monitor how many people are using our Services, our Site and those of selected partners, sponsors and advertisers and for what purposes. Our web beacons are not used to track your activity outside of our Site. We do not link Non-Personal Information from web beacons to Personal Information without your permission.

    3. Traffic Data.

      We also automatically track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; (4) types of web browsers used to access the Site; (5) referring source which may have sent you to the Site; and (6) other information associated with the interaction of your browser and the Site (collectively “Traffic Data”). We do not link Non-Personal Information from Traffic Data to Personal Information without your permission.

  4. Our Use and Disclosure of Your Information.

    We may use your Personal Information to contact you when necessary, including to send you news about CookbookCreate, registration verification emails, order confirmations, purchase receipts, newsletters, special offers and in conjunction with your use of certain other Services. We may use your Non-Personal Information to customize and tailor your experience on the Site and in emails to you displaying content that we think you might be interested in and according to your preferences. In some cases, when you click on a link in an email from us, your browser may be momentarily directed to the website of a third party which, acting on behalf of CookbookCreate (please see Section 5 below), notes or “counts” your response to the email before re-directing your browser to your selected destination; this re-direction process may not be apparent to you.

    We may share your Personal and Non-Personal Information with our business partners who assist us by performing core services related to our operation of the Site and/or by making certain Services available to our Users (such as website hosting, payment processing, data storage and security). Those business partners shall be bound to uphold the same standards of security and confidentiality that we have promised to you in this Privacy Policy, and they will only use your Personal Information to carry out their specific business obligations. CookbookCreate does not share, sell, rent or trade your Personal Information with any third parties for their promotional purposes. In addition, we may transfer your Personal and Non-Personal Information to another company in connection with a merger, sale or acquisition by or of CookbookCreate. In this event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy. Lastly, we reserve the right to disclose your Personal Information as required by law and when disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.

  5. Information Collected By Third Parties.

    Certain Site content and Services may be served on websites hosted and operated by companies other than CookbookCreate, may feature advertisements and/or contain links to other websites with which CookbookCreate has no affiliation (“Third Parties”). CookbookCreate does not disclose your Personal Information to these Third Parties without your consent, but you should be aware that any information you disclose once you access these other websites is not subject to this Privacy Policy. CookbookCreate does not endorse and is not responsible for the privacy practices of these Third Parties, and you should review the privacy policy of any Third Party to which you volunteer information carefully.

    As part of the Services, we may enable you link your Cookbook Create Member account with your Facebook and/or Twitter and/or Pinterest and/or Google+ and/or email user accounts. In addition to this Privacy Policy, any and all use of such Services is governed by the Facebook Connect Platform Policies (accessible here:, the Twitter Privacy Policy (accessible here:, the Pinterest Privacy Policy (accessible here:, the Google+ Platform Developer Policies (accessible here:, the Google Privacy Policy (accessible here:, as applicable.

  6. Security.

    The Personal Information we collect about you is stored on a secure, password-protected server and only authorized personnel have access to your Personal Information. We use industry-standard encryption technologies with respect to the receipt and transfer of Personal Information. Nevertheless, despite our best efforts, no transmission over the Internet and no data storage method can be guaranteed to be safe one hundred percent (100%) of the time.

  7. Transfer and Storage of Data.

    The Site is hosted on servers in the United States. Accordingly, if you are located outside of the United States, the Personal Information you provide to us will be transferred to the United States. By submitting your Personal Information, you consent to its transfer and storage in the United States and its use in accordance with the purposes for which it was collected.

  8. Changes to This Privacy Policy.

    We reserve the right to change the Privacy Policy at any time, in our sole discretion. Upon any change in the Privacy Policy, we will post the amended agreement on the Site with notice of the changes and/or send you an email notifying you of the nature of the modifications and providing a link to the modified document for your review. In all cases, use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
